Unclaimed Funds

Most unclaimed funds arise when a trustee attempts to distribute dividends (assets) to a creditor(s) in a case and the money is returned to the court as being "unclaimed". The unclaimed fund(s) is deposited by the court into the U.S. treasury until the court approves release of the funds to the entitled creditor.

Creditors who believe they are entitled to an unclaimed fund must file with the court an application and proposed order, including proof of identity. See below for the Chapter 13 and Chapter 7 Unclaimed Fund Forms.
