Notice Regarding New Procedures for Striking Pleadings Filed in Closed Cases
NOTICE REGARDING NEW PROCEDURES FOR STRIKING PLEADINGS FILED IN CLOSED CASES
Effective February 23, 2009 pleadings filed in closed cases which require the reopening of the case will be stricken without prejudice. Pursuant to 11 U.S.C. § 350 a case may be reopened to administer assets,
to accord relief to the debtor or for other cause. An order granting a motion to reopen is required in these circumstances.
Only the following pleadings may be filed after a case is closed without first obtaining an order reopening.
Motion to Reopen
Requests and Writ of Garnishment
Certificate of Service
Applications to Pay Unclaimed Funds
Affidavit of Claimant for Unclaimed Funds
Request to be Removed from Receiving Electronic Filings
Affidavit of Non-compliance
