Notice of Amendments to Federal & Local Bankruptcy Rules and Forms
NOTICE OF AMENDMENTS TO FEDERAL AND LOCAL BANKRUPTCY RULES AND FORMS
Barring Congressional action, amendments to several federal bankruptcy rules and official forms
will take effect December 1, 2003. A number of these amendments will implement the Judicial
Conference policy on privacy and public access to electronic court files. The policy states that
personal identifiers such as social security numbers of individuals should be redacted to the last
four digits of the numbers by the person filing a document with the court. The clerk is not
responsible for redacting social security numbers and other personal identifiers such as dates of
birth, financial account numbers, and names of minor children in documents filed with the court.
Local bankruptcy rules and forms have also been amended, or newly created, to reflect the
amendments to the federal rules. The following is a synopsis of the amendments:
Federal Rules Amendment
1005 Requires only the last four digits of the
debtor’s social security number on the bankruptcy petition.
(NOTE: the full EIN or other Tax ID number is required)
1007(a)(1) Corporate debtors must file a statement
regarding corporate ownership.
1007(f) Requires the debtor to submit a verified
statement of his or her full social security number. The statement is not filed
in the case and is not part of the court record available to the public.
2002(a)(1) Requires the clerk to include the debtor’s full
social security number on the §341 notice to creditors. The court copy of the notice will not
contain the full number.
2003(b) Reflects the enactment of a new subchapter V
of chapter 7 of the Bankruptcy Code that makes multilateral clearing organizations eligible for
bankruptcy relief.
2009(a)-(c) Reflects the enactment of a new subchapter V of
chapter 7 of the Bankruptcy Code that makes multilateral clearing organizations eligible for
bankruptcy relief.
2016(c) Requires a petition preparer to file a
disclosure of compensation paid or promised.
7007.1 Requires parties in adversary
proceedings to disclose corporate entities that own 10% or more of the
stock of the party.
Local Rules Amendment
1007-1(e) Pursuant to Administrative Order 03-13, the
caption of the petition shall disclose the last four digits of all social security numbers used by
the debtor(s) within the past 6 years. All other requirements of this rule remain in effect.
7067-1(b)(1) Pursuant to Administrative Order 03-13, an order
for the withdrawal of funds held in an interest bearing account or registry account shall state the
names, addresses, and last four digits of the social security number of the recipients of the
funds. All other requirements of this rule remain in effect.
Official Forms
Voluntary Petition (Form 1) Requires only the last four digits of the debtor’s social
security number.
Involuntary Petition (Form 5) Requires only the last four digits of the alleged debtor’s
social security number.
Schedules (Form B6) Schedules D, E, F are amended to require disclosure of
only the last four digits of the debtor’s account number with each listed creditor. Schedule I is
amended to delete the disclosure of the names of the debtor’s minor dependents.
Statement of Financial Requires only the last four digits of the social security
Affairs (Form 7) number and account numbers.
Proof of Claim (Form 10) Requires only the last four digits of a wage claimant’s
social security number.
Statement of Social Security A new official form required to be submitted, not filed,
Number(s) (Form 21) with the bankruptcy petition.
Local Forms
Statement of Debtor Pursuant to Administrative Order 03-14, this form shall
be Regarding Corporate used to comply with amended Fed. R. Bank. P.
1007(a)(1). Ownership
Statement Regarding Pursuant to Administrative Order 03-14, this form shall
be Corporate Ownership used to comply with new Fed. R. Bank. P. 7007.1.
(Adversary Proceedings)
Statement of Petition Pursuant to Administrative Order 03-15, this form shall be
Preparer used to comply with new Fed. R. Bank. P.

Summons Amended to reflect requirements under new
(Adversary Proceedings) Fed. R. Bank. P. 7007.1 and Administrative Order 03-14.
The amended or new forms are effective for all cases and adversary proceedings filed on or after
December 1, 2003.
